By using the Site, you agree to these Terms. If you do not agree, please do not use the Site. ## 1. Menu, prices and availability Menu items, descriptions, photos, prices, hours and promotions shown on the Site are for general information and may change without notice. Photos are for illustration; actual dishes may vary. Prices do not include applicable taxes, fees or gratuity. In case of a difference, the price charged in the restaurant or on our ordering platform applies. ## 2. Allergies and dietary needs Our kitchen handles common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish and shellfish. We cannot guarantee that any dish is free of allergens or cross-contact. Please tell your server about any allergy or dietary need before ordering. Consuming raw or undercooked meats, poultry, seafood, shellfish or eggs may increase your risk of foodborne illness. ## 3. Orders, reservations and delivery Online orders and payments are handled by Toast, reservations by OpenTable, and delivery by third-party services such as DoorDash and Uber Eats. Those services are subject to their own terms and policies. We are not responsible for the availability, performance or actions of third-party platforms or their drivers. ## 4. Promotions Promotions (for example, our Tuesday pizza offer) are valid only on the stated days, while supplies last, and may not be combined with other offers unless stated. Promotions have no cash value and may be changed or ended at any time. ## 5. Private events Private events, large parties and catering are confirmed only by a signed event agreement, which governs deposits, minimums, cancellations and other details. Information on the Site about events is not an offer or a binding commitment. ## 6. Gift cards Gift cards are subject to the terms provided at purchase and to applicable law. ## 7. Use of the Site You agree to use the Site lawfully and not to interfere with its operation, attempt to gain unauthorized access, or copy, scrape or misuse its content. ## 8. Intellectual property The Zilú name, logo, photos, text and design of the Site belong to Zilú or its licensors and are protected by law. You may not use them without our written permission. ## 9. Third-party links and content The Site contains links to and content from third parties, including Google reviews displayed through Trustindex. We do not control and are not responsible for third-party websites, services or content. ## 10. Disclaimer The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, and do not guarantee that the Site will be uninterrupted, error-free or free of harmful components. ## 11. Limitation of liability To the fullest extent permitted by law, Zilú and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law. ## 12. Governing law These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, Florida. ## 13. Changes to these Terms We may update these Terms from time to time. The date at the top shows when they were last changed. Continued use of the Site after an update means you accept the revised Terms. ## 14.
